    Just got refused a job because I'm British

    Hey all,

    Been looking for a job for a while now, I'm lucky if I ever get a reply from anyone anymore and even if its an email telling me I wasn't successful it is nice because at least I know where I stand and I can then move on. However I applied for one a few days ago with my CV included and today I had a reply saying that They could not continue with my application as they are only looking for non British EU applicants. I am understandibly fuming about this and we are all told we have to not be racist and accept this is a multi cultural Britian, but its getting very hard not to get annoyed when things like this happen. Now please I just hope that nobody thinks about writing the tired and overused sentence "stop reading the daily mail" I keep seeing on fourms a lot now, because this isn't something I have seen on the news or read in a paper, this has actually hasppened to me. Now is there a chance that I can seek legal action about racial descrimination? because I heard there is a rumor going around that it does work both ways. After all if it was an ethnic minority person applying and the employer said "sorry we are only looking for English people." there would be an absolute uproar.

    Bloody hell mate that is bad!

    I am an employer and my understanding is that you cannot hire or fire on the basis of race or ethnic background.

    If I were you I would seek some legal advise. I might be wrong, but I would never have given that as a reason in writing as to why I would not hire someone. Truth is that you cannot really stop employers doing it, because they can just make up another reason. But the fact thay have put it in writing, was a bad move on their part if you ask me!

    yeah i have the email as sent in original unedited form, the only thing that worries me is because I am unemployed its the cost of legal fees are any lawyers even going to touch me?

    Was there any excemptions on the advert?

    There can be some jobs that allow positive discrimination legally.

    What type of job was it? Does the trade have a odbudsman or society etc you can contact?

    It was a Uk job doing administrative work. I have been applying for all kinds of different things at the moment just to see if there really is anything that doesn't have 400 applicants trying to get.

    If im honest mate, I dont know. If I were you I would seek a employment specialist. Give them a call and ask if you can have a free consultation to discuss your case. Many solictors will give you some free time to see if you have a case or not. If you do have a strong case and there is enough money to be had out of it then they may do it on a no win no fee basis. If you dont ask you wont find out.

    Employers can positively discriminate legally.
    This is when a job has to be done by a certain type of person.

    For instance a person who has to take care of vulnerable women you could positively discrimanate against sex to not employ a man.

    But if you do this i believe it has to be stated on the advert as a requirement and the reasons?

    If no such valid reason exists then you have been discriminated against on grounds of your ethnicity and have a case.
